Licence applications: Legislation enabling the domestic cultivation, production and manufacture of cannabis for medicinal purposes commenced on 30 October 2016.


Application forms for medicinal cannabis licences, cannabis research licences and manufacture licences are now available online which can be accessed on the application forms and guidance page of the ODC website. 


Please ensure you are familiar with all guidelines and guidance documents prior to commencing any application.


Should you have difficulty completing or submitting your application using the online form, please email mcs.application@health.gov.au.

TGA - Advertising guidance for businesses involved with medicinal cannabis products

The guidance provided through the link below is intended to assist stakeholders with an interest in disseminating information about medicinal cannabis to ensure they do not illegally advertise prescription medicines, including unapproved medicines only available through special access pathways, to consumers. 


The guidance aims to assist providers of medicinal cannabis products and therapies (including sponsors, manufacturers, importers, pharmacists, health professionals and marketers) to comply with the therapeutic goods advertising restrictions. Criminal and civil penalties may apply if you do not comply with your legal requirements.


The focus of this guidance is to help you to understand how to promote your business and service without advertising medicinal cannabis products to the public, which is prohibited.


The guidance provides information about:

  • the definition of advertising as it applies to therapeutic goods
  • activities that may constitute advertising
  • advertising compliance and enforcement

Therapeutic Goods Administration - Advertising complaints

Therapeutic goods advertising is subject to the requirements of the Therapeutic Goods Act 1989 (the Act), as administered by the Therapeutic Goods Administration (TGA). The majority of the Act's requirements apply solely to consumer based advertising. Only a small number of requirements in the Act apply to advertising directed exclusively to health professionals. This is because health professionals have the appropriate knowledge and skill to critically analyse advertisements and recognise their persuasive intent.


Exposing consumers to advertising intended for health professionals may disrupt the doctor/patient relationship and create an inappropriate demand for a good, or encourage inappropriate self-diagnosis. Therefore, it is important that consumers do not access advertising meant for health professionals. Advertisers can choose the way advertising is restricted; however, inadequate restriction may lead to advertiser non-compliance.

The TGA may pursue sanctions and penalties against those who do not comply with the advertising and other applicable regulatory requirements. Failing to have regard to the general principles set out on this TGA site may risk the statement or promotion being a contravention of the Therapeutic Goods Act 1989 (the Act) and the Therapeutic Goods Advertising Code (No.2) 2018 (the Code).
